In the Nevada, the law (NRS 484.448) is simple – it is against the law to drink any alcoholic beverage and controlling a motor vehicle.
Similarly, you cannot have an open container of alcohol in the passenger section of the vehicle (NRS 484.448).
But what is considered the “passenger section.?” Most people think it is the seat in the front next to the driver, but that is not the case. Any seat within the vehicle where a person can sit is considered the “passenger section” to include the back seat.
There are two exceptions to this law where open container is allowed:
- Vehicles for hire (limousines, taxi cabs, shuttle busses)
- Motor homes
