Selling or serving alcohol is a serious offense, so what can you do to protect yourself and ensure you are following the law?
Your only defense is proof that you asked the minor for identification before they were served or sold alcohol and that you did your “due diligence” and honestly believe the identification that was presented to you was legitimate.
Most business have established policies regarding when to check for ID. Some will suggest if they look under 40 ask to see ID. There is no law requiring you must check someone’s ID when they looker younger than a certain age. You should go with your company’s policy.
